The dismissal of the director of the Saint-Martin Hospital has been suspended by the administrative court

In a ruling handed down on Wednesday, May 20, the Administrative Court of Saint Martin suspended the order to dismiss and remove Sébastien Galleyn from his position. On March 4, the then-director of the Louis Constant Fleming Hospital Center in Saint Martin had been sanctioned by the general management of the National Center for the Management of Hospital Practitioners and Executive Staff in the Public Hospital System.
In its ruling, the Administrative Court ordered the National Management Center to proceed with the “legal reinstatement” of the dismissed director to his position within fifteen days. In his petition to the judge presiding over summary proceedings, Sébastien Galleyn asserts that there is “serious doubt as to the legality of the order,” emphasizes that “his rights to a defense were disregarded,” and that “the proceedings before the disciplinary board were irregular ." The court ruled in his favor.
The sanction imposed on the director of the healthcare facility came after the discovery of a post deemed discriminatory and racist on a so-called “social” media platform.
Following the court’s decision, the director’s salary and benefits must be reinstated. It remains to be seen whether the civil servant will resume his duties at the hospital.
