Administrative, legal, budgetary and human resources issues. This is the menu that will be proposed to the Collectivité's elected representatives at the territorial council meeting scheduled for Monday December 29 at 5pm. This last meeting before the end of 2025 will also be marked by the arrival of a new territorial councillor.
Following the resignation of Romaric Magras, who headed the list and then the Saint-Barth d'Abord group since the March 2022 elections, Diana Bourel will be officially installed in the deliberative assembly. She joins the ranks of Saint-Barth d'Abord alongside Alexandra Questel, Senator Micheline Jacques, Rudi Laplace, Sylvère Gréaux and Francius Matignon. Although Matignon has "withdrawn" from his group, he has not resigned. This hardly contributes to the balance of an assembly that has become increasingly fragmented since the beginning of the mandate.
Administrative matters
Once they have welcomed their new colleague, the elected members will turn their attention to five administrative matters. Firstly, a modification to the constitution of the internal working and study committees. This follows the departure of Sandra Baptiste and Romaric Magras, who have been replaced by Sylvère Gréaux and Diana Bourel respectively. The aim is to formalize the appointment of the two new members to the working committees.
The elected representatives will then proceed with the adoption of the service regulations for non-collective sanitation. These regulations adapt national legislation to the local context, taking into account the island's particular features.
The document also aims to regularize situations that are not explicitly authorized by national regulations, such as the installation of concrete septic tanks built on site.
5.2 million from the European Commission
The territorial council will then be asked to approve the rules and regulations of the Maison des associations. They will also be asked to authorize the President to sign a financing agreement with the European Commission. The agreement covers the Saint-Barth Digital Hub project. This involves connecting Saint-Barthélemy to the Celia system via a submarine cable. Validated at the time of the 2025 budget vote, the project is estimated to cost a total of 14.6 million euros, and was approved by the European Commission last August for a grant of 5.2 million euros. The Collectivité will therefore invest just under 9.4 million euros in the project.
In conclusion, elected representatives will be asked to waive the application of late payment penalties to companies involved in the construction and fitting-out of the Rockefeller space.
Legal affairs
The seventh item on the agenda concerns Legal Affairs. More specifically, a formal notice to acquire the parcels cadastralized AY 55, AY 88, AY 89 and AY 90, owned by SCI du Petit-Cul-de-Sac. This same owner has given the Collectivité formal notice to acquire all these parcels for a price of three million euros. These parcels make up a vast area of water and moorland that forms the Petit Cul-de-Sac pond and its surrounding area. On December 4, 2024, the "Service des Domaines" issued an updated appraisal, assessing the overall value of the plots at 633,510 euros. With a 15% margin, this price could rise to 728,500 euros, according to the local authority. The proposed sale price of three million euros was therefore not accepted by the Collectivité. "In view of the public interest in their acquisition, it is nevertheless appropriate to expressly mandate the President of the Territorial Council to refer the matter to the expropriation judge for a ruling on the transfer of ownership.the transfer of ownership to the Collectivité and to set the price and the amount of the re-use indemnity", the resolution states. Elected representatives will now have to decide on how to proceed.
Human resources
The next item on the agenda is a modification to the employment table. This involves the creation of three positions (an administrative manager, a receptionist and a social and family economics assistant) and the modification of four others.
The second point in the "human resources" section concerns the revaluation of the employer's contribution to the complementary social health and provident protection of local staff. The increase in the share paid by the Collectivité varies between five and fifteen euros, depending on the category and parental situation of the employee.
The tenth item is a "framework deliberation" concerning the mechanism for the general and uniform revaluation of the IFSE (Indemnité de fonctions, de sujétions et d'expertise) for territorial service agents.
Budgetary matters
Finally, the last two deliberations concern an amending decision and an "authorization to commit, liquidate and mandate investment expenditure before the adoption of the 2026 budget".
